Letter to My Landlord
Mohammad Abu Sakha è stato arrestato il 14 dicembre 2015 alle 4 circa mentre stava attraversando il posto di blocco militare Zaatara vicino a Nablus per andare a lavorare nel villaggio di Birzeit, vicino a Ramallah. Abu Sakha lavora come formatore e interprete presso la scuola di circo palestinese dal 2007. Era uno studente. È diventato un artista circense e un allenatore al circo nel 2011. Ha partecipato a molti spettacoli in Europa e negli Stati Uniti. Partecipa inoltre a numerose tournée in Palestina. Doveva partecipare a corsi di formazione fuori della Palestina nel mese di marzo e giugno 2016.
Un ordine di detenzione amministrativa di sei mesi è stato emesso contro Mohammad a partire dal 25 dicembre 2015 e termina il 13 giugno 2016. L’accusa militare afferma che Abu Sakha è attivo in un’organizzazione illegale secondo gli ordini militari di occupazione. L’accusa ha anche affermato che Abu Sakha partecipa in attività militari senza specificare i dettagli di queste attività, oltre a sostenere che egli è affiliato con altri detenuti senza identificare i nomi di questi detenuti. Il giudice militare ha confermato l’ordine di detenzione amministrativa senza avere prove o informazioni chiare adeguate, o anche senza indagare l’accuratezza delle informazioni che è stata presentata contro di lui dalla Procura militare. Il giudice ha affermato che Abu Sakha rappresenta una seria minaccia e che le condizioni generali richiedono di tenerlo in detenzione.
La detenzione amministrativa è una procedura che consente all’esercito israeliano di tenere in detenzione a tempo indeterminato su prove segrete e senza processo.
Nei territori palestinesi occupati della West Bank, l’esercito israeliano è autorizzato ad emettere ordini di detenzione amministrativa contro i civili palestinesi sulla base dell’ Ordine Militare del 1651. Questo ordine autorizza i comandanti militari di trattenere una persona per un massimo di sei mesi di periodi rinnovabili se hanno “ragionevole motivi per presumere che la sicurezza dell’area o della sicurezza pubblica richiede la detenzione. Poco prima della data di scadenza, l’ordine di detenzione è spesso rinnovata. Questo processo può essere continuato all’infinito.
