“Kelly Thomas was a mentally ill, homeless man beaten to death by the police in Fullerton, California. The police were found "Not Guilty", despite having the obvious crime on video and audio. Kelly can be heard pleading for his last breaths and screaming out that he was sorry. I came across the shocking audio and video of one of the most obvious cases of police brutality and murder I have ever seen. I wrote this song. I worked on it the following day and recorded it in the hut this morning and afternoon. It's the least I can do in telling this story. You can listen below.” Bryan McPherson
Kelly Thomas aveva gravi problemi mentali e per questo, negli ultimi anni, si era ridotto a vivere per strada. Aveva 36 anni quando, il 5 luglio del 2011, a Fullerton, California, il padrone di un locale notturno chiamò la polizia indicando in quel barbone l’autore di danneggiamenti alle vetture in sosta. Siccome Kelly Thomas “non si era mostrato collaborativo”, ben sei agenti grandi e grossi lo massacrarono a colpi di taser e a botte, riducendogli la faccia letteralmente in poltiglia e provocandogli asfissia a causa di una violenta e protratta compressione toracica. In pratica, lo schiacciarono come un insetto… Kelly Thomas morì il 10 luglio senza aver mai ripreso conoscenza.
Un buttafuori testimoniò che Kelly Thomas non aveva mai dato nessun problema ma che il titolare del locale (Jeremy Popoff, chitarrista della indie-band californiana dei Lit) pretendeva che fossero allontanati tutti i barboni dalla zona, perché i clienti non dovevano essere infastiditi. Il testimone in questione aveva subìto un licenziamento proprio perché non era stato abbastanza solerte nell’adempiere alle disposizioni impartite e quella sera Popoff si era inventato tutto solo per chiamare la polizia a finire il lavoro che i buttafuori non avevano, secondo lui, fatto a dovere.
I poliziotti (oggi dimissionari) che uccisero Kelly Thomas si chiamano Manuel Ramos, Jay Cicinelli e Joseph Wolfe.
Processati, sono stati tutti assolti da ogni imputazione, nonostante l’evidenza delle loro responsabilità comprovata anche dall’esistenza di un agghiacciante video amatoriale.
